Jack Smith's latest Indictment completely ignores the recent Presidential Immunity holding of the SCOTUS. Smith's allegations included communications with Vice President Pence, members of Congress, State Officials, and comments to the public as the President.
These acts are clearly within his official duties as President, and therefore he is presumptively immune. Smith can't present those immune acts to the grand jury to obtain an indictment against President Donald J. Trump !
Smith tries to dodge immunity by saying that the facts alleged were related to campaigning for office; not the operation of the office. He is clearly forum shopping by filing in D.C. after being dismissed in the Florida District Court. The dismissal by the FL federal court Judge was based on the Appointment Clause, holding that Smith is a private citizen and barred from prosecuting criminal cases. Smith's latest filing doesn't cure that critical defect.
This is clearly election interference by the deranged DOJ. This D.C. case shall fail for the same reasons as before.
